May 3, 2024 – McClelland Law Firm is investigating claims against Republic Services for imposing additional health insurance premiums, fees, or surcharges on tobacco users.  This may be an unlawful penalty for tobacco use; if so, employees are entitled to a reimbursement of the overcharges.

Employers may charge additional premiums for tobacco use, but only if they meet certain strict requirements.  One requirement is that employers must give tobacco users a way to avoid the surcharge other than to simply "quit smoking."
