Law Firm Investigating
Tobacco Surcharge Claims

For Immediate Release / Advertising Material

October 9, 2024 – McClelland Law Firm is investigating claims against Publix Super Markets, Inc. for imposing higher health insurance premiums on smokers (or providing a tobacco-free discount for non-smokers).  This may be an unlawful penalty for tobacco use; if so, employees are entitled to a reimbursement of the overcharges.

Employers cannot charge higher premiums for tobacco use unless they meet strict requirements.  One requirement is that they give tobacco users a way to avoid the surcharge other than to simply "quit smoking" - and, they most give notice of this alternative option.

If you worked for Publix within the last six years and paid a higher insurance rate because you smoke, you may be entitled to compensation.  Please E-Mail Us for more information.
