Bally's Casino Accused of Violating Wage Laws

For Immediate Release
A class action lawsuit is pending against Bally's Casino for failing to pay its hourly employees properly under federal wage laws. The lawsuit covers hourly employees at Bally's Dover, Bally's Twin River Lincoln Casino Resort, and Bally's Tiverton Casino & Hotel.
The lawsuit seeks to recover unpaid wages for all hourly employees who worked at Bally's between December 21, 2017 and the present.
Eligible persons who want to participate in this case may submit a Consent to Join form.
The complaint alleges that Bally's violated its employees’ rights by: (1) improperly “rounding” employees’ clock-in and clock-out times such that they were not paid for all hours worked; (2) failing to inform tipped employees of the required tip credit provisions before paying a sub-federal minimum wage; and (3) miscalculating tipped employees’ overtime rates resulting in unpaid overtime wages.
The case is Ruotolo v. Twin River Worldwide Holdings, Inc., et al., No. 1:20-cv-00530-WES-PAS, pending in the U.S. District Court for the District of Rhode Island.
