Tropicana Atlantic City Casino Accused of Violating Wage Laws

A class action lawsuit is pending against Tropicana Atlantic City Corp. d/b/a Tropicana Casino Resort for failing to pay its tipped employees properly under federal and state wage laws.  

The lawsuit seeks to recover unpaid wages for tipped employees who worked at Tropicana Atlantic City within the last three years.  Eligible persons who want to join this action can submit a Consent to Join form to participate in the litigation.

 

The complaint alleges that Tropicana violated their employees’ rights by: (1) improperly “rounding” employees’ clock-in and clock-out times; (2) failing to inform tipped employees of the required tip credit provisions before paying a sub-federal minimum wage; and (3) miscalculating tipped employees’ overtime rates resulting in unpaid overtime wages.

 

The case is Pasquale v. Tropicana Atlantic City Corp., No. 1:20-cv-06909, pending in the U.S. District Court, District of New Jersey.
