June 16, 2025 – McClelland Law Firm is investigating claims against Nordstrom, Inc. for imposing higher health insurance premiums (or "tobacco surcharges") on its employees. This may be an unlawful penalty for tobacco use; if so, employees are entitled to a reimbursement of the overcharges.
Employers may charge higher premiums for tobacco use, but only if they meet certain strict requirements. One requirement is that employers must give tobacco users a way to avoid the surcharge other than demanding that they simply "quit smoking" -- and they must give notice of the alternative option.
