Mount Airy Casino Resort Accused of Violating Wage Laws

February 7, 2025 -- A putative collective action lawsuit is pending against Mount Airy Casino Resort in Mount Pocono, Pennsylvania, alleging it failed to pay its employees properly under federal and state wage laws.  

The lawsuit seeks to recover unpaid wages for employees who worked at Mount Airy Casino Resort within the last three years.  Eligible persons who want to join this action can learn more and submit a Consent to Join form to participate in the litigation.

 

The complaint alleges that Mount Airy Casino Resort violated its employees’ rights by: (1) improperly “rounding” employees’ clock-in and clock-out times; (2) failing to inform tipped employees of the required tip credit provisions before paying less than the federal minimum wage; (3) creating a mandatory tip pooling policy by which it requires its table games dealers to pool their tips and then, in violation of federal law, distributing those tips to the table games dealers who earned them as well as to pay the PTO of certain non-tipped manager and supervisor employees; and (4) miscalculating their employees' regular rate of pay for overtime purposes. 

 

The case is Mak v. Mount Airy #1, LLC d/b/a Mount Airy Casino Resort, No. 3:25-cv-00238, pending in the U.S. District Court, Middle District of Pennsylvania.
