June 25, 2025 – We are investigating claims against Cracker Barrel for imposing higher health insurance costs on employees who smoke (a "tobacco surcharge" of 25% of the total medical plan cost).  

 

This may be an unlawful penalty for tobacco use; if so, employees are entitled to a reimbursement of the overcharges. 

Employers may charge higher premiums for tobacco use, but only if they meet certain strict requirements.  One requirement is that employers must give tobacco users a way to avoid the surcharge other than demanding that they simply "quit smoking" -- and they must give notice of the alternative option. 

 

If you worked for Cracker Barrel within the last six years and paid more for health insurance because you smoke, you may be entitled to compensation.
