March 27, 2024 -- McClelland Law Firm is investigating claims against Compass Group for imposing additional health insurance premiums, fees, or surcharges on tobacco users.​ This may be an unlawful penalty for tobacco use.  If so, employees are entitled to a reimbursement of the overcharges. 

 

Employers may charge additional premiums for tobacco use, but only if they meet certain strict requirements.  One requirement is that employers must give tobacco users a way to avoid the surcharge other than not smoking, and they must provide notice of the alternative option.
